 Regulatory prosecutions occupy an increasingly prominent place in environmental and planning practice. Legislative obligations have increased, penalties have escalated, regulators' expectations of compliance have sharpened, and practitioners are more likely than ever to find themselves involved in enforcement proceedings. However, the decisions that shape a prosecution are often made well before anyone stands up in court: how to investigate, what to charge, what to concede or challenge, and when to resolve.
