Say What You Mean, Mean What You Say: Drafting and Interpreting Planning Schemes and Local Laws

This seminar seeks to provide insight and tips on how to interpret planning schemes, especially in light of recent Court decisions and the new Planning Act 2016.  

The seminar will also address drafting effective and appropriate local laws, with learnings from Redland City Council in using local laws or schemes to effectively regulate vegetation clearing.

Rod Litster QC will discuss statutory interpretation in a local government context including references to Court of Appeal and Planning and Environment Court decisions.

Keith Wylie will provide helpful insights to the powers local authorities hold to making local laws, the jurisdictional limits of local laws, what occurs when local laws go beyond these limits, and how local authorities can ensure that they don’t exceed these requirements.

Jonathan Lamb will be presenting on the experiences of Redland City Council as a case study in drafting effective local laws, planning schemes, and amendments to these instruments, particularly with respect to regulating tree clearing activities.
